On the other hand, it should also be noted that dividends from overseas companies are generally offshore in nature and not subject to tax in Hong Kong.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who_is_liable_for_paying_Profits_Tax_in_Hong_Kong\"><\/span>Who is liable for paying Profits Tax in Hong Kong?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">According to the Inland Revenue Ordinance (IRO), a person is liable to pay <a href=\"http:\/\/www.ird.gov.hk\/eng\/paf\/bus_pft_tsp.htm#a02\">Hong Kong Profits Tax if the <\/a><\/span><span style=\"font-weight: 400;\">following conditions<\/span><span style=\"font-weight: 400;\"> are met: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">He carries on a trade, profession or business in Hong Kong;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The trade, profession or business derives profits; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The profits arise in or are derived from Hong Kong.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">With regard to the last requirement, what is essential to note is that taxation in Hong Kong is based on the <\/span><a href=\"http:\/\/www.ird.gov.hk\/eng\/paf\/bus_pft_tsp.htm\"><span style=\"font-weight: 400;\">territorial source principle<\/span><\/a><span style=\"font-weight: 400;\">. For the uninitiated, this means that companies registered in Hong Kong will only be liable to pay taxes on profits that come from within Hong Kong. It does not have to fork out taxes on profits sourced from outside of Hong Kong. <\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"How_do_I_determine_what_profits_are_taxable\"><\/span>How do I determine what profits are taxable?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Companies are taxed based on their Assessable Profits, which <\/span><span style=\"font-weight: 400;\">are the net profits (or loss) [other than profits (or loss) arising from the sale of capital assets] for the basis period, arising in or derived from Hong Kong. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The following sums are excluded from the Assessable Profits:-<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dividends received from a corporation which is subject to Hong Kong Profits Tax;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Amounts already included in the assessable profits of other persons chargeable to Profits Tax;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Interest on Tax Reserve Certificates;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Interest on, and any profit made in respect of a bond issued under the Loans Ordinance (Cap. 61) or the Loans (Government Bonds) Ordinance (Cap. 64), or in respect of an Exchange Fund debt instrument or in respect of a Hong Kong dollar-denominated multilateral agency debt instrument;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Interest income and trading profits derived from <\/span><a href=\"http:\/\/www.ird.gov.hk\/eng\/tax\/bus_qdi.htm#a02\"><span style=\"font-weight: 400;\">long term debt instruments<\/span><\/a><span style=\"font-weight: 400;\">; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sums received or accrued in respect of a specified investment scheme by or to the person as:<\/span><\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a person chargeable to Profits Tax in respect of a mutual fund, unit trust or similar investment scheme that is authorized as a collective investment scheme under section 104 of the Securities and Futures Ordinance (Cap. 571); or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a person chargeable to Profits Tax in respect of a mutual fund, unit trust or similar investment scheme where the Commissioner is satisfied that the mutual fund, unit trust or investment scheme is a bona fide widely held investment scheme which complies with the requirements of a supervisory authority within an acceptable regulatory regime.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"When_is_the_filing_of_Profits_Tax_returns_due\"><\/span>When is the filing of Profits Tax returns due?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You must file a different Profits Tax Return to the Inland Revenue Department (IRD) depending on the type of business you operate: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Corporations (BIR51)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Persons Other Than Corporations (BIR52)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In Respect Of Non-Resident Persons (BIR54)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Generally, profits tax return should be filed within 1 month from the date of issue.
