This has sparked global fear over the risk of infection and has stoked vigilance among Hong Kong citizens to stay clean and safe. <\/span><\/p>\n<p><span id=\"E166\" class=\"qowt-font4-Arial\">The Hong Kong government allowed civil servants and government employees to work from home until February <\/span><span id=\"E167\" class=\"qowt-font4-Arial\">16<\/span><span id=\"E168\" class=\"qowt-font4-Arial\">. The government also urged private sector employers and work-places to follow suit, to curb the spread of disease within the city. <\/span><\/p>\n<p id=\"E170\"><span id=\"E171\" class=\"qowt-font4-Arial\">With educational institutions suspending classes, and the government issuing health warnings to stay home and reduce contact with others, how are professionals supposed to cope? If you are an employee and unsure of your rights, this article is here to help. <\/span><\/p>\n<h4 id=\"E173\"><span id=\"E174\" class=\"qowt-font4-Arial\">Do I have to work from home?<\/span><\/h4>\n<p id=\"E176\"><span id=\"E177\" class=\"qowt-font4-Arial\">In Hong Kong, it is implied that employees have the right to work. Therefore, employers cannot suspend employees without an express power stated in a contract or statute. This would mean that ordinarily an employer would not be able to simply suspend their staff\u2019s employment. <\/span><\/p>\n<p><span id=\"E177\" class=\"qowt-font4-Arial\">However, in the context of the Coronavirus outbreak, requiring employees to be \u2018suspended\u2019 and work from home has a low possibility of legal repercussions. This is due to the regulations that are put in place for quarantine and to protect employee health in the workplace.<\/span><\/p>\n<p id=\"E179\"><span id=\"E180\" class=\"qowt-font4-Arial\">During the 2002 outbreak of SARS, the Hong Kong Labour Department encouraged <\/span><span id=\"E181\" class=\"qowt-font4-Arial\">employers to create work-place contingency plans and allows<\/span><span id=\"E182\" class=\"qowt-font4-Arial\"> employees in \u201cspecial risk categories\u201d to take leave or work from home. These categories <\/span><span id=\"E183\" class=\"qowt-font4-Arial\">may include <\/span><span id=\"E184\" class=\"qowt-font4-Arial\">pregnant employees or those who have infected family members. These rules are not mandatory, <\/span><span id=\"E185\" class=\"qowt-font4-Arial\">but <\/span><span id=\"E186\" class=\"qowt-font4-Arial\">it is <\/span><span id=\"E187\" class=\"qowt-font4-Arial\">likely <\/span><span id=\"E188\" class=\"qowt-font4-Arial\">the government may adopt <\/span><span id=\"E189\" class=\"qowt-font4-Arial\">a similar arrangement <\/span><span id=\"E190\" class=\"qowt-font4-Arial\">when dealing with the <\/span><span id=\"E191\" class=\"qowt-font4-Arial\">Coronavirus.<\/span><\/p>\n<p id=\"E193\"><span id=\"E194\" class=\"qowt-font4-Arial\">Employees can also be requested to stay or work from home if they pose a likely threat to the safety and health of <\/span><span id=\"E195\" class=\"qowt-font4-Arial\">colleagues within the office. <\/span><span id=\"E196\" class=\"qowt-font4-Arial\">This is generally determined case by case, but <\/span><span id=\"E197\" class=\"qowt-font4-Arial\">some of the <\/span><span id=\"E198\" class=\"qowt-font4-Arial\">obvious indicators include any employees who have recently travelled to Wuhan or Hubei<\/span><span id=\"E199\" class=\"qowt-font4-Arial\"> Province, the PRC<\/span><span id=\"E200\" class=\"qowt-font4-Arial\">, and those who are suspected<\/span><span id=\"E201\" class=\"qowt-font4-Arial\"> or confirmed carriers of the virus.<\/span><\/p>\n<p id=\"E203\"><span id=\"E204\" class=\"qowt-font4-Arial\">Therefore, an employer can request an employee to stay\/work from home <\/span><span id=\"E206\" class=\"qowt-font4-Arial\">as long as<\/span><span id=\"E208\" class=\"qowt-font4-Arial\"> it is reasonable, such as protecting others\u2019 health and safety within the workplace.<\/span><\/p>\n<h4 id=\"E210\"><span id=\"E211\" class=\"qowt-font4-Arial\">Do I still get paid if I work from home?<\/span><\/h4>\n<p id=\"E213\"><span id=\"E214\" class=\"qowt-font4-Arial\">In short, yes. Unless the contract of employment has been terminated, your employer should continue to pay wages and should not refuse to do so because you are unable to go to work due to the outbreak. This is especially important for an employer<\/span><span id=\"E215\" class=\"qowt-font4-Arial\">,<\/span><span id=\"E216\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E217\" class=\"qowt-font4-Arial\">because<\/span><span id=\"E218\" class=\"qowt-font4-Arial\"> by continuing to pay normal wages<\/span><span id=\"E219\" class=\"qowt-font4-Arial\">, it <\/span><span id=\"E220\" class=\"qowt-font4-Arial\">would <\/span><span id=\"E221\" class=\"qowt-font4-Arial\">help avoid<\/span><span id=\"E222\" class=\"qowt-font4-Arial\"> claims surrounding disability discrimination or constructive dismissal<\/span><span id=\"E223\" class=\"qowt-font4-Arial\">. <\/span><\/p>\n<\/div>\n<\/div>\n<h4 id=\"pageBorders\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-32831  aligncenter\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-1024x785.jpg\" alt=\"\" width=\"567\" height=\"435\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-1024x785.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-300x230.jpg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-768x589.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-1536x1177.jpg 1536w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-640x491.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268-1200x920.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/02\/michael-amadeus-oidJ1WGkIeY-unsplash-scaled-e1593932875268.jpg 1644w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 567px\" \/><\/h4>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<h4 id=\"E225\"><span id=\"E226\" class=\"qowt-font4-Arial\">Can an employer force me to have my temperature tested or go to the doctor?<\/span><\/h4>\n<p id=\"E228\"><span id=\"E229\" class=\"qowt-font4-Arial\">Generally, an employer may ask an employee to see the doctor or have <\/span><span id=\"E230\" class=\"qowt-font4-Arial\">his or her<\/span><span id=\"E231\" class=\"qowt-font4-Arial\"> temperature tested if the <\/span><span id=\"E232\" class=\"qowt-font4-Arial\">staff<\/span><span id=\"E233\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E234\" class=\"qowt-font4-Arial\">agrees to do so<\/span><span id=\"E235\" class=\"qowt-font4-Arial\"> voluntarily. Considering the invasive nature of directing an employee to seek out a doctor, a contractually express power might be needed for the employer to do so. While possible, the main concern <\/span><span id=\"E236\" class=\"qowt-font4-Arial\">behind <\/span><span id=\"E237\" class=\"qowt-font4-Arial\">these medical tests would be data privacy.<strong> The Personal Data (Privacy) Ordinance (PDPO)<\/strong>, primarily Data Protection Principle 1, provides the purpose and manner of data collection. The PDPO states that the collection of personal data must be lawful and within fair circumstances. Therefore, the biggest risk employers run when requiring employees to seek a doctor is that <\/span><span id=\"E238\" class=\"qowt-font4-Arial\">this <\/span><span id=\"E239\" class=\"qowt-font4-Arial\">could possibly be viewed as <\/span><span id=\"E240\" class=\"qowt-font4-Arial\">an <\/span><span id=\"E241\" class=\"qowt-font4-Arial\">unlawful or unfair collection of personal data. Considering temperature checking and medical records are a form of personal data collection, employers must be vigilant in explicitly explaining, inter alia, to whom the employee\u2019s data will be sent to and for what purpose. Those who fail to do so may be in breach of the PDPO. <\/span><\/p>\n<p id=\"E243\"><span id=\"E244\" class=\"qowt-font4-Arial\">While there may be legal repercussions for employers who force their <\/span><span id=\"E245\" class=\"qowt-font4-Arial\">staff <\/span><span id=\"E246\" class=\"qowt-font4-Arial\">to undergo medical testing against their will, employees who refuse to participate in such tests, may be reasonably denied access to the office or other communal workspaces. In terms of medical<\/span><span id=\"E247\" class=\"qowt-font4-Arial\"> expenses, <\/span><span id=\"E248\" class=\"qowt-font4-Arial\">the employer should cover the costs of testing, which should be confined to examining whether an employee is infected or is <\/span><span id=\"E249\" class=\"qowt-font4-Arial\">showing <\/span><span id=\"E250\" class=\"qowt-font4-Arial\">symptoms. <\/span><\/p>\n<h5 id=\"E252\"><span id=\"E253\" class=\"qowt-font4-Arial\">Extra point to note&nbsp;<\/span><\/h5>\n<p><span id=\"E253\" class=\"qowt-font4-Arial\">An employer must have a reasonable ground for requesting an employee to undergo a medical test. In the context of the Coronavirus outbreak, this could include determining whether an employee is infected or <\/span><span id=\"E254\" class=\"qowt-font4-Arial\">manifesting<\/span><span id=\"E255\" class=\"qowt-font4-Arial\"> symptoms of infection to prevent the spread of the virus to other employees within the office. <\/span><\/p>\n<h4 id=\"E257\"><span id=\"E258\" class=\"qowt-font4-Arial\">If I contract the <\/span><span id=\"E259\" class=\"qowt-font4-Arial\">C<\/span><span id=\"E260\" class=\"qowt-font4-Arial\">oronavirus, does the Employees\u2019 Compensation Ordinance (ECO) allow me to receive compensation? <\/span><\/h4>\n<p id=\"E262\"><span id=\"E263\" class=\"qowt-font4-Arial\">It depends. <\/span><span id=\"E263\" class=\"qowt-font4-Arial\">Under the ECO, the <\/span><span id=\"E264\" class=\"qowt-font4-Arial\">Coronavirus<\/span><span id=\"E265\" class=\"qowt-font4-Arial\"> is not (<\/span><span id=\"E267\" class=\"qowt-font4-Arial\">as of yet<\/span><span id=\"E269\" class=\"qowt-font4-Arial\">) listed as an occupational disease that allows for compensatory payment. While this is so, we can still look to section 36 of the ECO.<\/span><\/p>\n<p id=\"E271\"><span id=\"E272\" class=\"qowt-font4-Arial\">S. 36 ECO: \u201cnothing &#8230; shall prejudice the right of an employee to recover compensation under this Ordinance in respect of a disease to which this Part does not apply, if the disease is a personal injury by accident within the meaning of section 5.\u201d <\/span><\/p>\n<p id=\"E274\"><span id=\"E275\" class=\"qowt-font4-Arial\">This section essentially <\/span><span id=\"E276\" class=\"qowt-font4-Arial\">gives the employees the right <\/span><span id=\"E277\" class=\"qowt-font4-Arial\">to receive compensation for <\/span><span id=\"E278\" class=\"qowt-font4-Arial\">an illness<\/span><span id=\"E279\" class=\"qowt-font4-Arial\"> that has not been labelled as an \u2018occupational disease\u2019 if the infection of the disease can be said to be a personal injury by accident occurring amid employment. However, the ruling of whether infection of a disease results in an accidental personal injury is up to the Labour Department\u2019s discretion.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<h5 id=\"E281\"><span id=\"E282\" class=\"qowt-font4-Arial\">The Labour Department would need to find:<\/span><\/h5>\n<ul>\n<li id=\"E283\" class=\"qowt-li-0_0 qowt-list\"><span id=\"E284\" class=\"qowt-font4-Arial\">An \u2018accident\u2019<\/span><\/li>\n<li><span style=\"font-size: inherit;\">The accident must not be the disease itself<\/span><\/li>\n<li><span style=\"font-size: inherit;\">The accident must at least contribute to or result in the contraction of the disease\/injury<\/span><\/li>\n<\/ul>\n<p id=\"E291\"><span id=\"E292\" class=\"qowt-font4-Arial\">The Labour Department may take medical records, circumstantial evidence, and other applicable information to determine whether an accident has taken place. If the above criteria ha<\/span><span id=\"E293\" class=\"qowt-font4-Arial\">ve<\/span><span id=\"E294\" class=\"qowt-font4-Arial\"> been met, then it may be possible for an employee to receive compensation under the ECO if they have contracted the <\/span><span id=\"E295\" class=\"qowt-font4-Arial\">Coronavirus.<\/span><span id=\"E296\" class=\"qowt-font4-Arial\"> <\/span><\/p>\n<h4 id=\"E298\"><span id=\"E299\" class=\"qowt-font4-Arial\">Can my employer quarantine some employees in another building or section of the workplace?<\/span><\/h4>\n<p id=\"E301\"><span id=\"E302\" class=\"qowt-font4-Arial\">It is possible but in doing so the employer must be mindful not <\/span><span id=\"E303\" class=\"qowt-font4-Arial\">to<\/span><span id=\"E304\" class=\"qowt-font4-Arial\"> act contrary to the Disability Discrimination Ordinance (DDO). As an employee who has contracted or is suspected of having the <\/span><span id=\"E305\" class=\"qowt-font4-Arial\">Coronavirus <\/span><span id=\"E306\" class=\"qowt-font4-Arial\">will be considered someone with a \u2018disability\u2019 in the eyes of the DDO. Therefore, if not acting carefully, an employer could possibly be contravening the laws against discrimination. <\/span><\/p>\n<p><span id=\"E306\" class=\"qowt-font4-Arial\">However, an easy defence to this would be that this \u201cdiscriminatory act\u201d <\/span><span id=\"E308\" class=\"qowt-font4-Arial\">has to<\/span><span id=\"E310\" class=\"qowt-font4-Arial\"> be taken to protect the safety of others in the workplace or is taken in compliance with quarantine regulations.<\/span><\/p>\n<p id=\"E312\"><span id=\"E313\" class=\"qowt-font4-Arial\">Subject to the circumstances of the case, it may be reasonable for an employer to ask an employee to work in a separate section of the workplace if this is to protect the health and safety of others. It could also be possible for an employer to request the employee to work in a different office if the employee\u2019s contract allows for it, <\/span><span id=\"E315\" class=\"qowt-font4-Arial\">taking into account<\/span><span id=\"E317\" class=\"qowt-font4-Arial\"> the time and expenditure incurred <\/span><span id=\"E318\" class=\"qowt-font4-Arial\">by<\/span><span id=\"E319\" class=\"qowt-font4-Arial\"> the employee by changing offices. <\/span><\/p>\n<p><span id=\"E319\" class=\"qowt-font4-Arial\">One example of an unreasonable request would be to ask the employee to work in another country, when the employee is not required to travel overseas for his\/her work.<\/span><\/p>\n<h4 id=\"E321\"><span id=\"E322\" class=\"qowt-font4-Arial\">To summarise, what are the employer\u2019s common law duties?<\/span><\/h4>\n<p id=\"E324\"><span id=\"E325\" class=\"qowt-font4-Arial\">To answer this, we would have to look at mainly the <strong>Occupational Safety and Health Ordinance (OSHO), the Employment Ordinance (EO), the Employees\u2019 Compensation Ordinance (ECO), and the Disability Discrimination Ordinance (DDO).<\/strong><\/span><\/p>\n<h5 id=\"E327\"><span id=\"E328\" class=\"qowt-font4-Arial\">Under the OSHO:<\/span><\/h5>\n<p id=\"E329\" class=\"qowt-li-1_0 qowt-list\"><span id=\"E330\" class=\"qowt-font4-Arial\">An employer must ensure a practicable workplace that reasonably <\/span><span id=\"E332\" class=\"qowt-font4-Arial\">takes into account<\/span><span id=\"E334\" class=\"qowt-font4-Arial\"> the health and safety of employees<\/span><\/p>\n<h5 id=\"E336\"><span id=\"E337\" class=\"qowt-font4-Arial\">Under EO:<\/span><\/h5>\n<p id=\"E338\" class=\"qowt-li-2_0 qowt-list\"><span id=\"E339\" class=\"qowt-font4-Arial\">An employer must abide by the agreements under the EO and the <a href=\"https:\/\/zegal.com\/employment-contract\/\">employment contract<\/a> (such as paying wages)<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"pageBorders\">&nbsp;<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<h5 id=\"E341\"><span id=\"E342\" class=\"qowt-font4-Arial\">Under the DDO and ECO:<\/span><\/h5>\n<p id=\"E343\" class=\"qowt-li-3_0 qowt-list\"><span id=\"E344\" class=\"qowt-font4-Arial\">An employer must ensure the correct insurance in accordance with the <\/span><span id=\"E346\" class=\"qowt-font4-Arial\">ECO, and<\/span><span id=\"E348\" class=\"qowt-font4-Arial\"> must report any illnesses or deaths in the appropriate time-frame.<\/span><\/p>\n<p class=\"p1\" style=\"text-align: center;\"><b><i>This article does not constitute legal advice.<\/i><\/b><\/p>\n<p class=\"p2\" style=\"text-align: center;\"><i>The opinions expressed in the column above represent the author\u2019s own.<\/i><\/p>\n<p class=\"p3\" style=\"text-align: center;\"><span class=\"s1\"><a href=\"https:\/\/register.zegal.com\/\"><b>Start managing your legal needs with Zegal today<\/b><\/a><\/span><\/p>\n<p><a href=\"https:\/\/zegal.com\/blog\/post\/asia-apps-work-remotely\/\">READ MORE: 6 Apps Helping You Work Remotely<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;Mid-January of the new year 2020, marked the news of an outbreak of the Coronavirus.
