This determined that 31 January 2020 be the date the UK officially left the EU. <\/span><\/p>\n<p><span id=\"E170\">Now set in motion is a transition period where the EU and the UK will discuss the nature of their future relations until the 31 December 2020. <\/span><\/p>\n<p><span id=\"E170\">While the UK is still subject to EU laws and sanctions, despite not being a Member State, there is no doubt that there is lingering uncertainty for the future. However, this time is especially prudent for the UK, as during this period they will be able to contact international <\/span><span id=\"E172\">organisations<\/span><span id=\"E174\"> and third countries to <\/span><span id=\"E176\">finalise<\/span><span id=\"E178\"> international agreements. <\/span><\/p>\n<p><span id=\"E178\">There is no dispute that the UK has had a long history with Hong Kong and Singapore; however, the question for Hong Kong &amp; Singapore businesses<\/span><span id=\"E179\"> <\/span><span id=\"E180\">seems to be: How will Brexit affect Hong Kong &#8211; UK and Singapore &#8211; UK relations? <\/span><\/p>\n<h4 id=\"E182\"><span id=\"E183\">Business<\/span><span id=\"E184\"> and Trade<\/span><\/h4>\n<p id=\"E186\"><span id=\"E187\">In the business world, it may seem that the UK\u2019s official divorce from the EU has little to no impact as of now. This is mainly because<\/span><span id=\"E188\">,<\/span><span id=\"E189\"> during the transition period, the UK would still abide by the rules of the EU. Despite having already <\/span><span id=\"E191\">left, it<\/span><span id=\"E193\">\u00a0will also remain a member of Customs Union and EU Single Market. <\/span><\/p>\n<p><span id=\"E193\">Therefore, businesses operating in Hong Kong and Singapore can still easily sell their products to EU customers, with EU or UK<\/span><span id=\"E194\">&#8211;<\/span><span id=\"E197\">based investors, consumers and companies also have <\/span><span id=\"E198\">the <\/span><span id=\"E199\">business run its usual course. <\/span><\/p>\n<p><span id=\"E199\">However, the main change will be that EU bodies will no longer represent the UK within <\/span><span id=\"E200\">their<\/span><span id=\"E201\"> conduct or affairs. While everything is currently smooth sailing (politically &#8211; current pandemic excluded!), businesses in Asia<\/span><span id=\"E205\">\u00a0seem to adopt a relatively positive outlook on their relations with the UK, even before their official split from the EU. <\/span><\/p>\n<p id=\"E207\"><span id=\"E208\">Considering the UK&#8217;s more than <\/span><span id=\"E209\">\u00a38 billion investment in Hong Kong<\/span><span id=\"E210\"> \u2013with Hong Kong being a major player for UK exports in goods and services in the Asia-Pacific Market\u2013 it is easy to assume that this is a relationship both parties want to maintain. This is made clear as the British government has spoken optimistically about post-Brexit trade and investments with Hong Kong. Particularly regarding agreements to remove economic and commercial relational barriers with Hong Kong. <\/span><\/p>\n<p><span id=\"E210\">Therefore, we can hope to expect maintained relations within the trade sector between Hong Kong. Especially since the UK Head of British Parliamentary Committee Regarding China Relations told the <\/span><span id=\"E211\">South China Morning Post<\/span><span id=\"E212\"> that China and Hong Kong are priorities within trade negotiations post-Brexit. <\/span><\/p>\n<p id=\"E214\"><span id=\"E215\">As Brexit is now official, the UK is granted more autonomy and freedom to negotiate trade deals with other countries. This being one of their main priorities, especially with the EU. Considering Hong Kong and Singapore have their current Free Trade Agreements signed with Members States of the European Free Trade Association, we can hopefully expect a similar free trade deal to be struck up soon between Hong Kong and Singapore and the UK. <\/span><\/p>\n<p><span id=\"E215\">Both Hong Kong and <\/span><span id=\"E216\">the <\/span><span id=\"E217\">UK are known advocates of <\/span><span id=\"E219\">free-trade. So,<\/span><span id=\"E221\">\u00a0it comes as no surprise that both governments have issued a joint statement and launched a Strategic Dialogue on Trade Partnership, which encourages stronger relations and collaboration between the two in 2018. <\/span><\/p>\n<p><span id=\"E223\">In particular, this<\/span><span id=\"E225\"> would aim to boost teamwork within the areas of innovation, global free trade, creative industries, and the Belt and Road Initiative. Therefore, it is not hard to assume that we could expect further collaboration and partnership post-Brexit, as the UK gains more freedom.<\/span><\/p>\n<h4 id=\"E227\"><span id=\"E228\">What should Hong Kong and Singapore companies with relations in the UK do?<\/span><\/h4>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<p id=\"E229\"><span id=\"E230\">While the future post-Brexit holds many possible business opportunities, it should not be lost on potential investors that roadblocks and challenges are sure to present themselves when operating in a new political and administrative climate. <\/span><\/p>\n<p><span id=\"E230\">For example, Intellectual Property (which will be discussed below) regulations will change after the transition period. Whereby UK trademarks must be applied for and will no longer be protected within the EU after 1 January 2021. <\/span><\/p>\n<p id=\"E233\"><span id=\"E234\">Therefore, companies should be wary and take reasonable precautions when venturing into business with the UK post-Brexit. For example, lawyers advise:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: square;\">\n<li id=\"E236\" class=\"qowt-li-0_0 qowt-list\"><span id=\"E237\">Be sure to evaluate any contracts that extend past the transition period to ensure any changes to laws or regulations have been addressed<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: square;\">\n<li id=\"E238\" class=\"qowt-li-0_0 qowt-list\"><span id=\"E239\">Evaluate distribution and supply chains within the UK. This could include possibly moving their location to regulate possible tariffs that may be imposed after 31 Dec 2020<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: square;\">\n<li id=\"E240\" class=\"qowt-li-0_0 qowt-list\"><span id=\"E241\">Ensure transactions within the company such as administrative approvals and transaction structure are not disrupted <\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p id=\"E242\" class=\"qowt-li-0_0 qowt-list\"><span id=\"E243\">Stay vigilant within this year, as many changes may arise that <\/span><span id=\"E244\">will <\/span><span id=\"E245\">affect business operations as the UK prepares for its new independence from the EU.<\/span><\/p>\n<h4 id=\"E247\"><span id=\"E248\">Intellectual Property Rights<\/span><\/h4>\n<p id=\"E250\"><span id=\"E251\">As already established, the UK will continue to remain under the EU law during this transition period, which is set to end on the 31st of December. This means that the UK Intellectual Property (IP) system and UK IP Office (IPO) will stay as it has been until the end of this transition period. <\/span><\/p>\n<h4 id=\"E253\"><span id=\"E254\">But first, what is an EU trademark? <\/span><\/h4>\n<p id=\"E255\"><span id=\"E256\">The current structure in place within the EU &#8211; the EU Trademark system, registers trademarks across the EU in an integrated system, which allows a single registration to be protected within each EU member state. <\/span><\/p>\n<p><span id=\"E256\">This provides great protection to one\u2019s IP rights but due to the system being of a unified nature, a rejection from any member state within the EU would render the application null. <\/span><\/p>\n<p><span id=\"E256\">This is important as with the UK leaving the EU, there is great uncertainty on how that would impact Hong Kong and Singapore businesses or individuals who may have or are applying for an EU trademark, or those who want to do business within the UK. <\/span><\/p>\n<p id=\"E258\"><span id=\"E259\">However, on 29 January 2020, revised information regarding how Brexit would affect IP rights and EU trademarks had been posted on the UK government website. <\/span><span id=\"E262\">This update stated that the IPO (UK Intellectual Property Office) plans on converting 700,000 EU designs and 1.4 million EU trademarks to a set of comparable UK rights by the time the transition period is over. They will place the converted UK rights into effect by 1 January 2021. <\/span><\/p>\n<p><span id=\"E262\">This effectively means that EU Trademarks will continue to apply to the UK until the end of the transition period.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-33778 size-large\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-1024x684.jpg\" alt=\"the post brexit relationship\" width=\"1024\" height=\"684\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-1024x684.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-300x200.jpg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-768x513.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-1536x1025.jpg 1536w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-2048x1367.jpg 2048w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-640x427.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-1200x801.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2020\/03\/aerial-photography-of-high-rise-buildings-2693282-1920x1282.jpg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 770px\" \/><\/p>\n<h4 id=\"E264\"><span id=\"E265\">What do the experts say this means for Hong Kong and Singapore? <\/span><\/h4>\n<p id=\"E267\"><span id=\"E268\">This section mainly applies to those, either Hong Kong or Singapore based individuals or companies, who have current EU Trademark applications that will continue to be ongoing until the end of the transition period. <\/span><\/p>\n<h5 id=\"E270\"><span id=\"E271\">For those who have ongoing EU Trademark Applications:<\/span><\/h5>\n<p id=\"E272\"><span id=\"E273\">While it may seem fairly uncertain as to how the UK would convert EU Trademarks to be UK applicable, <\/span><span style=\"font-size: inherit;\">the government notice has assured that those with ongoing applications are granted 9 months from 31 Dec <\/span><span id=\"E274\" style=\"font-size: inherit;\">2020 (<\/span><span id=\"E277\" style=\"font-size: inherit;\">i.e<\/span><span id=\"E279\" style=\"font-size: inherit;\"> the end of the transition period) to apply for the same protections within the UK. <\/span><\/p>\n<p><span id=\"E279\" style=\"font-size: inherit;\">However, this application must be in relation to the same trademark subject to the EU application.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<h5 id=\"E281\"><span id=\"E282\">For those with currently existing EU <\/span><span id=\"E284\">Trademarks :<\/span><\/h5>\n<p id=\"E286\"><span id=\"E287\">Those with EU Trademarks registered before the end of the transition period (before 1 Jan 2021), you do not need to worry as the IPO would grant you a comparable UK trademark.<\/span><\/p>\n<p id=\"E289\"><span id=\"E290\">Hong Kong and Singapore applicants would not need to reapply for an EU Trademark, as they will still be effective in the remaining EU member states. In turn, this would mean that EU trademarks are no longer protected in the UK, and the same would apply for UK rights within the EU. <\/span><\/p>\n<h4 id=\"E292\"><span id=\"E293\">Property<\/span><\/h4>\n<p id=\"E295\"><span id=\"E296\">As the UK has finally left Britain, some of the uncertainty holding Hong Kong and Singapore real-estate investors back during 2016-19 has been put to rest. As more decisions are being made and the finality of Brexit looms, as soon as the transition period is over, more and more Chinese, Hong Kong, and Singapore investors are expressing interest in purchasing UK property.
