As an employee you are <a href=\"https:\/\/zegal.com\/blog\/post\/types-leave-employees-entitled-new-zealand\/\">entitled to different types of leave<\/a>&nbsp;annually.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In case, if an employee has been <strong>working less than 12 months<\/strong> then it\u2019s on employer to decide whether to let employees take some of their annual holidays in advance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some important points regarding annual leave for employees:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employee can have at least 4 weeks\u2019 paid annual leave a year.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employee and employer has to agree with about when employee want to take leave.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Payment regarding should be included in <a href=\"https:\/\/zegal.com\/employment-contract\/\">employment contract<\/a>.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employee can ask to swap up to 1 week of your annual leave for cash each year.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">One can take unpaid leave if employer agree on it. (in case you complete your paid leave).<\/span><\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"Employees_right_to_take_annual_Leave_in_New_Zealand\"><\/span><strong><span style=\"font-size: 24pt;\">Employees right to take annual Leave in New Zealand.<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Annual leave can be taken as per agreement between employee and employer. Employee have authority to take at least two of the four weeks\u2019 annual holidays continuously.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You have the right to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">To take at least 2 weeks long leave <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">take leave whenever you want,as per agreement with employer<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">carry over leave into the next year \u2014 though your employer can make you take leave in some circumstances.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Your employer can:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">tell you when you have to take time off, as long as they give you at least 2 weeks&#8217; notice<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">restrict &nbsp;you to take leave in some cases like at busy periods.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If you don&#8217;t take all annual leave with in 12 months, then it&#8217;s added to your next year&#8217;s leave.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-8800 aligncenter\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-300x199.jpeg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-300x199.jpeg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-768x509.jpeg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-1024x678.jpeg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-640x424.jpeg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-1200x795.jpeg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2018\/01\/incentive-1920x1272.jpeg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 300px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Incase employees are in first year of working and don\u2019t have any leave employer must pay you 8% of the gross pay earned since started working for employer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You can take leave in closedown in 2 ways, but they need your employer&#8217;s agreement.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You can take annual leave in advance.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Your employer can change the date you receive your annual leave allowance so you have some paid leave to tide you over the closedown. If they do this, then the date they choose must be near to the start of the annual closedown and it becomes your leave anniversary from then on.<\/span><\/li>\n<\/ol>\n<p>Payment regarding your Standard annual leave.<\/p>\n<p><span style=\"font-weight: 400;\">Basically employment agreement should state about when employee get paid for time off and how your pay is worked out.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"How_much_Employee_Will_get_paid_for_annual_leave_In_new_Zealand\"><\/span><strong><span style=\"font-size: 24pt;\">How much Employee Will get paid for annual leave In new Zealand?<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">While you\u2019re on annual leave in New Zealand, you&#8217;re paid at the rate of at least the greater amount of:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">ordinary weekly pay (OWP) as at the beginning of the annual holiday, or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the employee\u2019s average weekly earnings (AWE) for the a months immediately before the end of the last pay period before the annual holiday.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For example<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You work part time. Your regular days of work are Tuesday and Wednesday, but you often pick up weekend shifts when they&#8217;re available.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you take a week off, you&#8217;ll be paid the average amount you&#8217;ve earned a week over the last 12 months \u2014 because that amount will be more than what you&#8217;d get for your regular hours on Tuesdays and Wednesdays.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&nbsp;<a href=\"https:\/\/www.employment.govt.nz\/assets\/Uploads\/tools-and-resources\/flowcharts\/df7b3fa737\/Holiday-Act-Guidance-tools-4-Ordinary-Weekly-Pay-vs-Average-Weekly-Earnings.pdf\">Ordinary Weekly Pay vs Average Weekly Earnings<\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you take leave in advance your payment then depends on 2 cases :<\/span><\/p>\n<p><strong>Case 1: \u200bIf you&#8217;ve been in the job for less than 12 months<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">You get paid whichever is greater:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">your ordinary weekly pay (at the beginning of the annual holiday), or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">your average weekly earnings since starting the job.<\/span><\/li>\n<\/ul>\n<p><strong>Case 2: If you&#8217;ve been on parental leave in the last 12 months<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Your payments for annual leave are affected in the 12 months after you return to work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They&#8217;re also affected if your work anniversary happens:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">when you&#8217;re on parental leave<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">when you&#8217;re in a period of preference \u2014 a 26-week period where if your employer offers a job that is very similar to yours, they must offer it to you first.<\/span><\/li>\n<\/ul>\n<p>You must be clear about annual leave payment <a href=\"https:\/\/zegal.com\/blog\/post\/signing-contract-for-a-job\/\">before you sign your employment contract.<\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"You_can_convert_annual_leave_to_cash_In_New_Zealand\"><\/span><strong><span style=\"font-size: 24pt;\">You can convert annual leave to cash In New Zealand.<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If the employee have served for 12 months then employee can swap annual leave for cash.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An employer can\u2019t:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">pressure their employee into cashing up holidays<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">raise it in wage or salary negotiations<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">make cash up a condition of employment<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">put a cash up request into an employment agreement, but can include the process for making a request.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"What_should_you_know_about_taking_unpaid_leave\"><\/span><strong><span style=\"font-size: 24pt;\">What should you know about taking unpaid leave?<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If your employer has an annual closedown and you don\u2019t have enough leave, you may have to take unpaid leave.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you take more than a week of unpaid leave over the year, you can agree with your employer if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the unpaid leave will have any effect on when you get your annual leave or how much you get paid for it, or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">that you&#8217;ll move the date of your anniversary out by the amount of unpaid leave you took, so you get your annual leave entitlement later each year from then on.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Pay-as_you-go_in_annual_leave_in_NZ\"><\/span><strong><span style=\"font-size: 24pt;\">Pay-as you-go in annual leave in NZ<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Every employee has the right to four weeks\u2019 annual holidays per year applies to all types of employees. But in some cases &nbsp;some employees may be paid their annual holiday entitlement on a pay-as-you-go basis.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This case arise in following cases<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the employee is employed on a genuine fixed-term agreement of less than 12 months, or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the employee works so intermittently or irregularly that it is impractical for the employer to provide them with 4 weeks\u2019 annual holidays.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In both of these situations:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the employee must agree to it in their employment agreement and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the 8% gross earnings must be shown as an identifiable component of the employee\u2019s pay.<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.employment.govt.nz\/assets\/Uploads\/tools-and-resources\/flowcharts\/4957c9d4f8\/Holiday-Act-Guidance-tools-8-percent-instead-of-annual-holidays.pdf\"><span style=\"font-weight: 400;\"> 8% instead of annual holidays<\/span><\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Annual_Close_down_in_annual_leave\"><\/span><strong><span style=\"font-size: 24pt;\">Annual Close down in annual leave<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If the employer regularly &nbsp;closedowns or business has an annual closedown, employees may have to take their annual holidays entitlement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">annual closedown can occur:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">across an entire workplace, or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">for part of an organisation (eg where a factory closes for maintenance while the office, dispatch and sales departments stay open).<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.employment.govt.nz\/assets\/Uploads\/tools-and-resources\/flowcharts\/041c775957\/closedowns-guidance-flowchart.pdf\"><span style=\"font-weight: 400;\">Pdf about Closedowns.<\/span><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>You employee have annual leave entitlement for four weeks&#8217; after 12 months (a year) of continuous employment.
