Some say it <\/span><span id=\"E96\">all started with a tweet on 15 October 2017<\/span><span id=\"E97\"> when<\/span><span id=\"E98\">, Alyssa Milano, American actress, producer, activist, and singer <\/span><span id=\"E99\">(<\/span><span id=\"E100\">perhaps best known to those in my generation as Phoebe from Charmed<\/span><span id=\"E101\">) shared the poignant post <\/span><span id=\"E102\">\u201c<em>If you\u2019ve been sexually harassed or assaulted write \u2018me too\u2019 as a reply to this tweet.<\/em>\u201d <\/span><span id=\"E105\">Within 24 hours, Milano\u2019s post had drawn thousands of replies, comments and retweets. <\/span><\/p>\n<p><span id=\"E105\">This marked the startling establishment of the Me Too movement. <\/span><\/p>\n<p id=\"E107\"><span id=\"E108\">But, long before Milano used her celebrity and the world connecting tool of Twitter to draw attention to sexual harassment, <span id=\"E112\">civil rights activist, <\/span><\/span><span id=\"E110\">Tarana<\/span><span id=\"E112\"> Burke, <\/span><span id=\"E113\">sparked this conversation back in 2006 <\/span><span id=\"E114\">and began using the phrase &#8220;Me Too&#8221; to raise awareness of the <\/span><span id=\"E115\">ubiquity<\/span><span id=\"E116\"> of sexual abuse and assault in society<\/span><span id=\"E117\">. <\/span><span id=\"E120\">The phrase actually originated when Burke struggled to find the right words to reassure a young girl who confided in her about sexual abuse. As a sexual assault survivor herself, Burke wished she\u2019d told the young woman: \u201c<em>Me too<\/em>.\u201d<\/span><\/p>\n<p id=\"E122\"><span id=\"E123\">In response to the movement, on <\/span><span id=\"E124\">1 <\/span><span id=\"E125\">January<\/span><span id=\"E126\"> <\/span><span id=\"E127\">2018, 300<\/span><span id=\"E128\"> high profile women launch<\/span><span id=\"E129\">ed the<\/span><span id=\"E130\"> <\/span><strong><span id=\"E131\">T<\/span><span id=\"E132\">imes <\/span><span id=\"E133\">U<\/span><\/strong><span id=\"E134\"><strong>p<\/strong> campaign<\/span><span id=\"E135\">. <\/span><span id=\"E136\"> <\/span><span id=\"E137\">The campaign was born in response to the #MeToo movement and published its opening letter in The New York Times as a new year\u2019s resolution for the world to uphold. Effectively, the campaign was declaring that \u2018time\u2019s up\u2019 on the sexual harassment prevalent in so many work places around the world.<\/span><\/p>\n<p id=\"E139\"><span id=\"E140\">The movement blossomed and it wasn\u2019t long after, on <\/span><span id=\"E141\">28 <\/span><span id=\"E142\">January<\/span><span id=\"E143\"> 2018, <\/span><span id=\"E144\">that the symbol of the <\/span><span id=\"E145\">white rose <\/span><span id=\"E146\">took ranking over the red carpet <\/span><span id=\"E147\">at<\/span><span id=\"E148\"> the 2018<\/span><span id=\"E149\"> Grammy Awards for gender equality<\/span><span id=\"E150\">. Leaders and role models came together once again to communicate the message <\/span><span id=\"E151\">that <\/span><span id=\"E152\">\u201c<\/span><span id=\"E153\"><em>We choose the white rose because historically it stands for hope, peace, sympathy and resistance<\/em>.\u201d<\/span><\/p>\n<p id=\"E155\"><span id=\"E156\">It perhaps doesn\u2019t come as a surprise to many to hear that o<\/span><span id=\"E157\">ne in five women in England and Wales have experienced some type of sexual assault since the age of 16<\/span><span id=\"E158\"> (a<\/span><span id=\"E159\">ccording to official analysis of violent crime figures<\/span><span id=\"E160\">). <\/span><span id=\"E161\">The latest release of findings from the Crime Survey for England and Wales shows more than 510,000 women aged 16 to 59 \u2013 experienced some type of sexual assault in the past year alone.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-29482\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-1024x1024.jpg\" alt=\"\" width=\"1024\" height=\"1024\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-1024x1024.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-150x150.jpg 150w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-300x300.jpg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-768x768.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-640x640.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-1200x1200.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/t-chick-mcclure-GU4uIz1jnOw-unsplash-1920x1920.jpg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 770px\" \/><\/p>\n<h4 id=\"E163\"><span id=\"E164\">How Has the <\/span><span id=\"E165\">#<\/span><span id=\"E166\">MeToo Movement Helped?<\/span><\/h4>\n<p><span id=\"E166\"> Of course, it is undeniable that conversations across entertainment platforms have sparked conversations in smaller businesses and communities across the globe. <\/span><span id=\"E167\">According to Google, <\/span><span id=\"E168\">#<\/span><span id=\"E169\">MeToo has been searched in all 195 countries in the world within the past year.<\/span><\/p>\n<p id=\"E171\"><span id=\"E172\">Conversations, convictions and collaborations have been born by the campaign to fight against the inhumanities that many women face just going to their place of work. Those <\/span><span id=\"E173\">inhumanities are of course not limited to celebrities and entertainers. <\/span><span id=\"E175\">#MeToo <\/span>leader<span id=\"E176\">, <\/span><span id=\"E178\">Tarana<\/span><span id=\"E180\"> B<\/span><span id=\"E181\">urke, <\/span><span id=\"E182\">urges<\/span><span id=\"E183\"> to focus on systems, not celebrities, to confront sexual violence<\/span><span id=\"E184\">. <\/span><\/p>\n<p id=\"E186\"><span id=\"E187\">The Times magazine acknowledging that victims are victims, regardless of salary, unearthed <\/span><span id=\"E188\">the <\/span><span id=\"E189\">Silence Breakers<\/span><span id=\"E190\">, identified as individuals<\/span><span id=\"E193\"> who have spoken out about their alleged experiences. Both the title and the deeply affecting feature that accompanied, unveiled the scope of everyday survivors <\/span><span id=\"E194\">ranging from h<\/span><span id=\"E195\">ospital workers<\/span><span id=\"E196\">, h<\/span><span id=\"E197\">otel employees<\/span><span id=\"E198\">, te<\/span><span id=\"E199\">achers and professors. <\/span><span id=\"E200\">D<\/span><span id=\"E201\">espite their differences, it was the shared experience which brought the<\/span><span id=\"E202\">se people <\/span><span id=\"E203\">together<\/span><span id=\"E204\">, o<\/span><span id=\"E205\">ften their stories were \u201ceerily similar\u201d<\/span><span id=\"E206\"> and the community of Silence Breakers went on to be named the 2018 people of the year. <\/span><\/p>\n<p id=\"E208\"><span id=\"E209\">These movements have not only given survivors a forum to discuss their experiences, they&#8217;ve also raised important questions about civil and criminal statutes of limitations, and the scope and authority of nondisclosure agreements. While these movements have had a substantial social impact, th<\/span><span id=\"E210\">ere has of course been significant impact on the legal system and workplace safeguarding. <\/span><\/p>\n<p><span id=\"E210\">As a business, there are many preventative measures you can implement to stand up against sexual harassment in the workplace. The immortalisation of #MeToo shows that sexual abuse, sexual harassment and discrimination is still happening and silence, or inaction, is not the answer. Now is the time for employers to consider what steps they can take to be proactive in promoting a culture which addresses these behaviours and makes #MeToo a thing of the past.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-29488\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-1024x683.jpg\" alt=\"\" width=\"1024\" height=\"683\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-1024x683.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-300x200.jpg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-768x512.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-640x427.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-1200x800.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/tiago-felipe-ferreira-saJkxOZXPsk-unsplash-1920x1280.jpg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 770px\" \/><\/p>\n<h4 id=\"E212\" class=\"qowt-li-0_0 qowt-list qowt-stl-ListParagraph\"><span id=\"E213\">Take Complaints Seriously<\/span><\/h4>\n<p id=\"E214\"><span id=\"E215\">If an employee brings an allegation of sexual harassment to your attention<\/span><span id=\"E216\">, <\/span><span id=\"E217\">you should consider the courage it has taken for them to do so and how this may be impacting their performance at work. Thankfully,<\/span><span id=\"E218\"> #MeToo has <\/span><span id=\"E219\">provided a safe place for individuals who have been subject to sexual harassment in the workplace to feel as though they can vocalise their concerns and grievances<\/span><span id=\"E220\"> without repercussion. Employees should feel that they are able to report their concerns confidentially<\/span><span id=\"E221\">, without fear of repercussion or <\/span><span id=\"E222\">victimisation<\/span><span id=\"E223\">.<strong> You should have an<a href=\"https:\/\/zegal.com\/grievance-procedure\/\"> internal grievance policy;<\/a>\u00a0if an employee wishes to make the report formally, this should be activated.<\/strong> You should also take <\/span><span id=\"E225\">advice<\/span><span id=\"E227\"> as to whether the employee would benefit from a period of leave, assistance from professional helplines, or if the matter should be reported to the police to assist with the investigations. <\/span><\/p>\n<h4 id=\"E229\" class=\"qowt-li-0_0 qowt-list qowt-stl-ListParagraph\"><span id=\"E230\">Be Sensitive<\/span><\/h4>\n<p id=\"E231\"><span id=\"E232\">Manage complaints sensitively and keep an open mind. What is acceptable can be subjective and everyone\u2019s thresholds are different. What one person may see as banter, another may see as harassment. <strong>Always remember that harassment is judged from the victim\u2019s perspective.<\/strong><\/span><span id=\"E233\"> The key to handling these matter properly is to listen to your employee; what exactly are they saying happened and when? What do they want to happen as a result of this? The decisions made in the workplace will impact this individual&#8217;s life and may also mean that they have to speak about a sensitive matter to people they may not know (HR), or even to their family who do not know yet. Make sure that the employee is prepared for what happens next. <\/span><\/p>\n<h4 id=\"E236\" class=\"qowt-li-0_0 qowt-list qowt-stl-ListParagraph\"><span id=\"E237\">Policies <\/span><\/h4>\n<p id=\"E239\"><span id=\"E240\">Employees will look to existing <a href=\"https:\/\/zegal.com\/anti-bullying-policy\/?juri=false\">policies<\/a> when they want to report an issue. <strong>An employment tribunal will also look at these when considering how an employer has managed the issue.<\/strong> Employers should make sure their policies are clear, accessible to all, reiterated often and show a commitment to promoting a culture where such behaviour is not acceptable or tolerated.<\/span><\/p>\n<h4 id=\"E242\" class=\"qowt-li-0_0 qowt-list qowt-stl-ListParagraph\"><span id=\"E243\">Manage the Situation<\/span><\/h4>\n<p id=\"E244\"><span id=\"E245\">Think about the victim but also about the alleged perpetrator; it will be difficult for them too. Keep it confidential and try to avoid other employees gossiping about it, especially where the employees work in the same team.<\/span><span id=\"E246\"> Whilst it is difficult, until the matter has been fully investigated, there should be no negative actions taken against the accused, this could give rise to other claims. Consider a period of paid suspension to ensure investigations can be carried out without interference or bias. <\/span><span id=\"E247\">This works both ways. The focus shouldn\u2019t just be on women. Whilst many businesses have established women\u2019s networks and host female only events, employers should be conscious of how this is perceived and could be discriminatory towards male employees. <strong>Diversity and inclusion initiatives succeed best where the whole workforce is actively encouraged to engage with the issues.<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25368 alignleft\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/04\/Photo-2.jpg\" alt=\"\" width=\"115\" height=\"140\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/04\/Photo-2.jpg 263w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/04\/Photo-2-247x300.jpg 247w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 115px\" \/><em>Terri Schofield is a first year LLM with LPC student at BPP, Manchester.
