This made it the third Australian state, following Queensland and South Australia, to enact such laws. <\/span><\/p>\n<p class=\"qowt-stl-NormalWeb\"><span id=\"E207\" class=\"qowt-font4-Arial\">A similar scheme is expected to be in the pipeline for the Australian Capital Territory. The Federal Government has also formed a coalition which proposed to establish some form of labour-regulating scheme. Nothing has yet been announced for Western Australia, the Northern Territory, or the New South Wales. But given the national trend<\/span><span id=\"E208\" class=\"qowt-font4-Arial\">,<\/span><span id=\"E209\" class=\"qowt-font4-Arial\"> it may be prudent to keep oneself informed of what the Act entails. <\/span><\/p>\n<h4 id=\"E211\" class=\"qowt-stl-NormalWeb\"><span id=\"E212\" class=\"qowt-font4-Arial\">What is the Act? <\/span><\/h4>\n<p id=\"E214\" class=\"qowt-stl-NormalWeb\"><span id=\"E215\" class=\"qowt-font4-Arial\">Put simply, in an effort to combat the exploitation of workers, the Act requires <\/span><strong><span id=\"E216\" class=\"qowt-font4-Arial\">businesses providing <\/span><span id=\"E217\" class=\"qowt-font4-Arial\">labour service<\/span><span id=\"E218\" class=\"qowt-font4-Arial\">s <\/span><\/strong><span id=\"E219\" class=\"qowt-font4-Arial\"><strong>in exchange for remuneration to be licensed.<\/strong> The Act also renders it unlawful for anyone to engage the services provided by an unlicensed labour<\/span><span id=\"E220\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E221\" class=\"qowt-font4-Arial\">hire provider. <\/span>&nbsp;<\/p>\n<h4 id=\"E223\" class=\"qowt-stl-NormalWeb\"><span id=\"E224\" class=\"qowt-font4-Arial\">Who does it apply to? <\/span><\/h4>\n<p id=\"E226\" class=\"qowt-stl-NormalWeb\"><span id=\"E227\" class=\"qowt-font4-Arial\">As the above suggests, <strong>the Act applies to a labour<\/strong><\/span><strong><span id=\"E228\" class=\"qowt-font4-Arial\">&#8211;<\/span><\/strong><span id=\"E229\" class=\"qowt-font4-Arial\"><strong>hire services provider.<\/strong> A company is deemed to be a labour<\/span><span id=\"E230\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E231\" class=\"qowt-font4-Arial\">hire services provider if <\/span><span id=\"E233\" class=\"qowt-font4-Arial\">it:-<\/span><span id=\"E235\" class=\"qowt-font4-Arial\"> <\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li id=\"E237\" class=\"qowt-li-1_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E238\" class=\"qowt-font4-Arial\">Supplies workers to a business, a \u201chost\u201d, to perform work for the host; and <\/span><span id=\"E239\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E241\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li><span style=\"font-size: inherit;\">Said worker is a worker of the company.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p id=\"E245\" class=\"qowt-stl-NormalWeb\"><span id=\"E246\" class=\"qowt-font4-Arial\">Such companies must, under the Act, apply for a license and be listed on the state\u2019s Public Register. Hosts are also required to only engage workers sourced from a licensed company. <\/span><\/p>\n<p class=\"qowt-stl-NormalWeb\"><span id=\"E246\" class=\"qowt-font4-Arial\">There are, however, as shown below, several classes of people exempt from the Act\u2019s requirements. <\/span><\/p>\n<h4 id=\"E248\" class=\"qowt-stl-NormalWeb\"><span id=\"E249\" class=\"qowt-font4-Arial\">What does one have to do in the application?<\/span><\/h4>\n<p id=\"E251\" class=\"qowt-stl-NormalWeb\"><span id=\"E252\" class=\"qowt-font4-Arial\">The application process varies for each state. For instance, a Victorian business may apply through the<\/span><span id=\"E253\" class=\"qowt-font4-Arial\"> local<\/span><span id=\"E254\" class=\"qowt-font4-Arial\"> <\/span><a id=\"E255\" contenteditable=\"false\" href=\"https:\/\/online.labourhireauthority.vic.gov.au\/Account\/Login?ReturnUrl=%2F\" target=\"_blank\" rel=\"noopener noreferrer\"><span id=\"E256\" class=\"qowt-font4-Arial qowt-stl-Hyperlink\">Labour Hire Authority&#8217;s website<\/span><\/a><span id=\"E257\" class=\"qowt-font4-Arial\">.<\/span><span id=\"E258\" class=\"qowt-font4-Arial\"> The Victorian regime also has the following <\/span><span id=\"E260\" class=\"qowt-font4-Arial\">requirements:-<\/span><\/p>\n<p><span id=\"E264\" class=\"qowt-font4-Arial\">The applicant business will have to demonstrate that it and its key personnel (such as directors) are able to satisfy the \u201cfit and proper persons\u201d test.&nbsp; <\/span><\/p>\n<ul>\n<li><span id=\"E265\" class=\"qowt-font4-Arial\">An applicant, be it a natural person or a body corporate, will not be found \u201cfit and proper\u201d if it has, within the last:<\/span><\/li>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: circle;\">\n<li><span id=\"E268\" class=\"qowt-font4-Arial\">10 years, been found guilty of an indictable offence against a person, or an offence involving fraud, dishonesty or drug trafficking that was punishable by imprisonment of 3 months or more (or an equivalent offence committed outside Victoria);<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: circle;\">\n<li class=\"qowt-li-3_0 qowt-list qowt-stl-NormalWeb\">5 years, have been found to have contravened some form of workplace law, labour<span id=\"E272\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">&#8211;<\/span><span id=\"E273\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">hire industry law, or minimum accommodation standards;<\/span><\/li>\n<li class=\"qowt-li-3_0 qowt-list qowt-stl-NormalWeb\">5 years, had his or its license under a labour<span id=\"E279\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">&#8211;<\/span><span id=\"E280\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">hire industry law cancelled, revoked or suspended involuntarily; <\/span><\/li>\n<li class=\"qowt-li-3_0 qowt-list qowt-stl-NormalWeb\">5 years, been insolvent or under external administration;<\/li>\n<li class=\"qowt-li-3_0 qowt-list qowt-stl-NormalWeb\">5 years, where the applicant is a body corporate, an officer was an officer of another body corporate whose license was cancelled, revoked or suspended involuntarily; or<\/li>\n<li class=\"qowt-li-3_0 qowt-list qowt-stl-NormalWeb\">5 years, the applicant was an officer of a body corporate and was disqualified <span class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">from managing corporations under the Corporations Act 2001 (<\/span><span id=\"E295\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">Cth<\/span><span id=\"E297\" class=\"qowt-font4-Arial\" style=\"font-size: inherit;\">).<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<ul>\n<li id=\"E299\" class=\"qowt-li-0_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E300\" class=\"qowt-font4-Arial\">The applicant will have to collate and provide information in respect of its operations and employees, including an Annual Report on their labour hiring activities. <\/span><\/li>\n<li id=\"E302\" class=\"qowt-li-0_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E303\" class=\"qowt-font4-Arial\">Applicants are required to demonstrate an understanding of and compliance with a number of laws, including taxation, superannuation, occupational health and safety, workers compensation, workplace, migration, and labour<\/span><span id=\"E304\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E305\" class=\"qowt-font4-Arial\">hire industry laws. <\/span><span id=\"E306\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E308\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E309\" class=\"qowt-li-0_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E310\" class=\"qowt-font4-Arial\">If an applicant has not, at the time of application, commenced business yet, he or it will have to declare that <\/span><span id=\"E311\" class=\"qowt-font4-Arial\">there is<\/span><span id=\"E312\" class=\"qowt-font4-Arial\"> already <\/span><span id=\"E313\" class=\"qowt-font4-Arial\">a <\/span><span id=\"E314\" class=\"qowt-font4-Arial\">formulated plan to comply with the above mentioned laws, and be ready to submit said plan upon request. <\/span><span id=\"E315\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E317\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<\/ul>\n<p id=\"E318\" class=\"qowt-li-0_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E319\" class=\"qowt-font4-Arial\">There are also a number of payable fees for the application and renewal of a license, as well as an annual fee. <\/span><\/h4>\n<p id=\"E385\" class=\"qowt-stl-NormalWeb\"><span id=\"E386\" class=\"qowt-font4-Arial\">A business <\/span><span id=\"E387\" class=\"qowt-font4-Arial\">involving the following classes of workers are excluded from the Act:<\/span><\/p>\n<ul>\n<li id=\"E389\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E390\" class=\"qowt-font4-Arial\">Workers employed by a single business on a regular basis, but are provided to work in another business on a temporary basis, with the expectation that they will eventually return to their original place of employment;<\/span><span id=\"E391\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E393\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E394\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E395\" class=\"qowt-font4-Arial\">Workers provided to another business which is a part of the same entity or group of entities as the providing business;<\/span><span id=\"E396\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E398\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E399\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E400\" class=\"qowt-font4-Arial\">A director who participates in the management or share of profits of a body corporate that has no more than 2 directors;<\/span><span id=\"E401\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E403\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E404\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E405\" class=\"qowt-font4-Arial\">Public sector employees seconded or transferred to work for another person;<\/span><span id=\"E406\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E408\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E409\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E410\" class=\"qowt-font4-Arial\">Students; and <\/span><span id=\"E411\" class=\"qowt-font4-Arial\"> <\/span><span id=\"E413\" class=\"qowt-font4-Arial\"><br \/>\n<\/span><\/li>\n<li id=\"E414\" class=\"qowt-li-2_0 qowt-list qowt-stl-NormalWeb\"><span id=\"E415\" class=\"qowt-font4-Arial\">Vocational placements. <\/span><\/li>\n<\/ul>\n<h4 id=\"E419\" class=\"qowt-stl-NormalWeb\"><span id=\"E420\" class=\"qowt-font4-Arial\">Is the Act extraterritorial in effect? <\/span><\/h4>\n<p id=\"E422\"><span id=\"E423\" class=\"qowt-font4-Arial\">Yes. The Act applies to Victorian businesses\u2019 engagements and arrangements in terms of work performed within Victoria. As well as arrangements made in Victoria in respect of work performed outside of Victoria. <\/span><\/p>\n<h4 id=\"E425\"><span id=\"E426\" class=\"qowt-font4-Arial\">Penalties<\/span><\/h4>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<p id=\"E428\"><span id=\"E429\" class=\"qowt-font4-Arial\">A labour<\/span><span id=\"E430\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E431\" class=\"qowt-font4-Arial\">hire provider who fails to comply with the Act\u2019s requirements, and who advertises that they provide labour<\/span><span id=\"E432\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E433\" class=\"qowt-font4-Arial\">hire services or actually provides labour<\/span><span id=\"E434\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E435\" class=\"qowt-font4-Arial\">hire services, shall be subject to maximum <strong>penalties exceeding $120,000 for natural persons and $500,000 for body corporates.<\/strong> <\/span><\/p>\n<p id=\"E437\"><span id=\"E438\" class=\"qowt-font4-Arial\">Conversely, hosts who engage the services provided by unlicensed labour<\/span><span id=\"E439\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E440\" class=\"qowt-font4-Arial\">hire providers shall incur maximum penalties exceeding $120,000 if a natural person and $500,000 if a body corporate. <\/span><\/p>\n<h4 id=\"E442\"><span id=\"E443\" class=\"qowt-font4-Arial\">Conclusion<\/span><\/h4>\n<p id=\"E445\"><span id=\"E446\" class=\"qowt-font4-Arial\">The Act is borne from legislative intention to ensure the legitimacy of <\/span><span id=\"E449\" class=\"qowt-font4-Arial\">labour<\/span><span id=\"E450\" class=\"qowt-font4-Arial\">&#8211;<\/span><span id=\"E451\" class=\"qowt-font4-Arial\">hire providers and the wellbeing and rights of vulnerable workers.
