It\u2019s there to assess whether a contractor is a genuine contractor or, what they call a \u2018disguised\u2019 employee, for the purposes of paying tax.<\/p>\n<p>Typically, contractors working through their own limited company benefit from a certain level of tax efficiency. However, they also don&#8217;t get the usual benefits like sick pay or holiday leave. Oftentimes, contractors will misuse this tax efficiency by working under self-employment status when they should be considered an employee.&nbsp;<\/p>\n<p>Thus, HMRC in the UK is amending the off-payroll working rules to stamp out this practice.&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who_is_affected_by_IR35_in_2021\"><\/span>Who is affected by IR35 in 2021?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Basically, the IR35 rules ensure that contractors, who would have been an employee if they were providing services directly to clients, pay the same tax and National Insurance contributions as employees. The changes were set to take effect in 2020 but were put on hold during the coronavirus pandemic. IR35 will now come into play on April 3, 2021.<\/p>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<p id=\"E181\"><span id=\"E186\" class=\"qowt-font7-Arial\">Also, the assessment obligation will sit with the business that engages the contractor<\/span><span id=\"E187\" class=\"qowt-font7-Arial\">. <\/span><span id=\"E189\" class=\"qowt-font7-Arial\">Should contractors be treated as employees for tax purposes, the <\/span><span id=\"E190\" class=\"qowt-font7-Arial\">client <\/span><span id=\"E191\" class=\"qowt-font7-Arial\">will <\/span><span id=\"E192\" class=\"qowt-font7-Arial\">then <\/span><span id=\"E193\" class=\"qowt-font7-Arial\">be responsible for the tax burden. <\/span><\/p>\n<p><span id=\"E193\" class=\"qowt-font7-Arial\">The changes to IR35 will have implications for medium to large businesses across all sectors. Particularly affected are oil &amp; gas, IT, financial services and construction.<\/span><span id=\"E194\" class=\"qowt-font7-Arial\"> According to the government,<strong> those who are genuinely self-employed will be unaffected.<\/strong><\/span><\/p>\n<p id=\"E198\"><span id=\"E199\" class=\"qowt-font7-Arial\">The IR35 legislation was initially <\/span><span id=\"E200\" class=\"qowt-font7-Arial\">aimed <\/span><span id=\"E201\" class=\"qowt-font7-Arial\">for disguised employment in the public sector, which came into effect in April 2017. And now it will also include the private sector from April 2020. <\/span><span id=\"E203\" class=\"qowt-font7-Arial\">In 2018, <\/span><span id=\"E204\" class=\"qowt-font7-Arial\"><strong>a BBC presenter was fined \u00a3419,151 in taxes<\/strong> after a UK tax tribunal ruled her contract should have been subject to IR35 legislation.<\/span><\/p>\n<h2 id=\"E209\"><span class=\"ez-toc-section\" id=\"Determining_IR35\"><\/span><span id=\"E210\" class=\"qowt-font7-Arial\">Determining IR35<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p id=\"E212\"><span id=\"E213\" class=\"qowt-font7-Arial\">To see whether you fall under IR35, HMRC will look at the whole picture, but there are three main principles:<\/span><\/p>\n<p id=\"E214\"><span id=\"E215\" class=\"qowt-font7-Arial\">1. <\/span><strong><span id=\"E216\" class=\"qowt-font7-Arial\">Substitution:<\/span><\/strong><span id=\"E217\" class=\"qowt-font7-Arial\"> Does the contractor have to carry out the work personally, rather than being able to send a substitute?<\/span><\/p>\n<p id=\"E218\"><span id=\"E219\" class=\"qowt-font7-Arial\">2. <\/span><strong><span id=\"E220\" class=\"qowt-font7-Arial\">Mutuality of obligation:<\/span><\/strong><span id=\"E221\" class=\"qowt-font7-Arial\"> Does the client have to provide the contractor with work, and\/or does the contractor have to carry out any work that the client requests?<\/span><\/p>\n<p id=\"E223\"><span id=\"E224\" class=\"qowt-font7-Arial\">3. <\/span><strong><span id=\"E225\" class=\"qowt-font7-Arial\">Contro<\/span><span id=\"E226\" class=\"qowt-font7-Arial\">l<\/span><span id=\"E227\" class=\"qowt-font7-Arial\">:<\/span><\/strong><span id=\"E228\" class=\"qowt-font7-Arial\"> Does the client have control over how, when, and where the contractor carries out the work?<\/span><\/p>\n<p id=\"E230\" class=\"qowt-stl-NormalWeb\"><span id=\"E231\" class=\"qowt-font7-Arial\">If <\/span><span id=\"E232\" class=\"qowt-font7-Arial\">the<\/span><span id=\"E233\" class=\"qowt-font7-Arial\"> answers are yes to these questions<\/span><span id=\"E234\" class=\"qowt-font7-Arial\">, this <\/span><span id=\"E235\" class=\"qowt-font7-Arial\">will indicate a quasi-employment relationship, which falls under I<\/span><span id=\"E236\" class=\"qowt-font7-Arial\">R<\/span><span id=\"E237\" class=\"qowt-font7-Arial\">35.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-44347\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1280x853.jpg\" alt=\"\" width=\"1280\" height=\"853\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1280x853.jpg 1280w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-320x213.jpg 320w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-768x512.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1536x1024.jpg 1536w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-2048x1365.jpg 2048w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-640x427.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1024x683.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1200x800.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2021\/03\/amy-hirschi-uwpo02K55zw-unsplash-1920x1280.jpg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 770px\" \/><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\">\n<div id=\"contents\">\n<h2 id=\"E241\"><span class=\"ez-toc-section\" id=\"IR35_2021_preparation\"><\/span><span id=\"E242\" class=\"qowt-font7-Arial\">IR35 2021 preparation<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p id=\"E244\"><span id=\"E245\" class=\"qowt-font7-Arial\">1. <strong>Communication. <\/strong><\/span><\/p>\n<p id=\"E247\" class=\"qowt-stl-NormalWeb\"><span id=\"E248\" class=\"qowt-font7-Arial\">Communication is key. It is in both parties\u2019 interests for tax and employment status to be confirmed well ahead of major legislative change or a status enquiry from HMRC. Start by having a compliant written contract. But the true relationship between contractor and client will always supersede any written terms.<\/span><\/p>\n<p id=\"E250\" class=\"qowt-stl-NormalWeb\"><span id=\"E251\" class=\"qowt-font7-Arial\">2. <strong>Collect evidence<\/strong><\/span><\/p>\n<p id=\"E252\" class=\"qowt-stl-NormalWeb\"><span id=\"E253\" class=\"qowt-font7-Arial\">For individual freelancers or contractors, <\/span><span id=\"E254\" class=\"qowt-font7-Arial qowt-stl-mfirst-letter\">y<\/span><span id=\"E255\" class=\"qowt-font7-Arial\">ou should collect evidence to show you belong outside IR35. Gather emails, supporting documents or agreements from a client reflecting that you operate as a genuine business. Should your client suddenly decide you belong inside IR35, if and when reform lands, you\u2019ll be in a stronger position to overturn the determination.<\/span><\/p>\n<h5 id=\"E256\" class=\"qowt-stl-NormalWeb\" style=\"padding-left: 40px;\"><span id=\"E257\" class=\"qowt-font7-Arial\">Evidence include<\/span><span id=\"E258\" class=\"qowt-font7-Arial\">s<\/span><span id=\"E259\" class=\"qowt-font7-Arial\"> your own company station<\/span><span id=\"E260\" class=\"qowt-font7-Arial\">a<\/span><span id=\"E261\" class=\"qowt-font7-Arial\">ry, website, business cards and your office address, which will strengthen your argument that you operate as a business in your own right.<\/span><\/h5>\n<p id=\"E264\"><span id=\"E265\" class=\"qowt-font7-Arial\">3. <strong>Consult a specialist<\/strong><\/span><\/p>\n<p id=\"E267\" class=\"qowt-stl-NormalWeb\"><span id=\"E268\" class=\"qowt-font7-Arial\">The sheer complexity of IR35 means it<\/span><span id=\"E269\" class=\"qowt-font7-Arial\"> is<\/span><span id=\"E270\" class=\"qowt-font7-Arial\"> worthwhile to have your contract reviewed by an unbiased and independent party. A specialist can carry out an IR35 contract review of not only your written contract but your actual working arrangement too. This will give you a well-informed view of your employment status.<\/span><\/p>\n<p id=\"E272\"><span id=\"E273\" class=\"qowt-font7-Arial\">4. <strong>Hire independent contractors as employees<\/strong><\/span><\/p>\n<p id=\"E275\"><span id=\"E276\" class=\"qowt-font7-Arial\">There is no way to circumvent IR35 by firms, other than to hire all contractors on fixed-term employment contracts. However, this <\/span><span id=\"E277\" class=\"qowt-font7-Arial\">would be an expensive way of eliminating the problem. And it<\/span><span id=\"E279\" class=\"qowt-font7-Arial\"> is <\/span><span id=\"E280\" class=\"qowt-font7-Arial\">extremely difficult for firms to renegotiate with all their existing contractors the kind of rate cut necessary to offset all the new taxes.<\/span><\/p>\n<p class=\"p1\" style=\"text-align: center;\">\n<\/div>\n<\/div>\n<p>If you engage sub-contractors regularly, you can complete a <a href=\"https:\/\/www.gov.uk\/guidance\/check-employment-status-for-tax\">Status Determination Statement&nbsp;<\/a>(SDS) so you are clear about the employment status for tax purposes.<\/p>\n<p>As April 2021 approaches, make sure you are all set for the new IR35 rules coming in to play the UK.
