When you see colleagues packing away their belongings into the ubiquitous brown cardboard box, you can\u2019t help but worry that you are next. Your fate is in the hands of the bosses above, but that doesn\u2019t mean you can\u2019t do anything to mitigate your losses. <\/span><\/p>\n<p id=\"E196\"><span id=\"E197\" class=\"qowt-font2-TimesNewRoman\">You might think you are in no position to bargain with your employer when your service is no longer wanted. But that\u2019s not true.&nbsp; Your employer often hopes to get something in exchange for granting you a satisfactory severance package. By paying you a fair sum of money for your time at the company, your employer can end your contract on good terms, free of personal grudges. This can save the company from potential lawsuits from ex-employees and establish a reputation for fairness. <\/span><span id=\"E197\" class=\"qowt-font2-TimesNewRoman\">If you play your cards right, you may just have the leverage to negotiate a fair package for your hard years of work.<\/span><\/p>\n<h4 id=\"E199\"><span id=\"E200\" class=\"qowt-font2-TimesNewRoman\">Items in your Severance Package<\/span><\/h4>\n<p id=\"E202\"><span id=\"E203\" class=\"qowt-font2-TimesNewRoman\">At this point, some may be wondering what exactly a severance package is. This is the money or benefits that an employee gets when he is terminated or forced to retire. <\/span><span id=\"E203\" class=\"qowt-font2-TimesNewRoman\">So what does a good severance package look like?<\/span><\/p>\n<h5 id=\"E205\"><span id=\"E206\" class=\"qowt-font2-TimesNewRoman\">The Paycheck<\/span><\/h5>\n<p id=\"E208\"><span id=\"E209\" class=\"qowt-font2-TimesNewRoman\">In Hong Kong, employees who are employed under a \u201ccontinuous contract\u201d for more than two years and are dismissed by reason of redundancy, are entitled to statutory severance payments. A continuous contract is automatically deemed if the employee has worked for the same employer for at least 18 hours in each of the past four weeks before getting laid off. <\/span><span id=\"E210\" class=\"qowt-font2-TimesNewRoman\">Capped at <\/span><strong><span id=\"E211\" class=\"qowt-font2-TimesNewRoman\">HK$390,000<\/span><\/strong><span id=\"E212\" class=\"qowt-font2-TimesNewRoman\">, t<\/span><span id=\"E213\" class=\"qowt-font2-TimesNewRoman\">he general calculation for a redundancy payment<\/span><span id=\"E214\"> <\/span><span id=\"E215\" class=\"qowt-font2-TimesNewRoman\">is as follows: <\/span><\/p>\n<table id=\"E217\">\n<colgroup id=\"columns\">\n<col>\n<col>\n<col><\/colgroup>\n<tbody>\n<tr id=\"E218\">\n<td id=\"E219\" colspan=\"1\" rowspan=\"1\">\n<div id=\"contents\">\n<p id=\"E220\"><span id=\"E221\" class=\"qowt-font2-TimesNewRoman\">\u2154 of either the last full months\u2019 wage <\/span><\/p>\n<p id=\"E222\"><span id=\"E223\" class=\"qowt-font2-TimesNewRoman\">or<\/span><\/p>\n<p id=\"E224\"><span id=\"E225\" class=\"qowt-font2-TimesNewRoman\">\u2154 of the average wages in the last 12 months <\/span><\/p>\n<p id=\"E226\"><span id=\"E227\" class=\"qowt-font2-TimesNewRoman\">or<\/span><\/p>\n<p id=\"E228\"><span id=\"E229\" class=\"qowt-font2-TimesNewRoman\">HK$22,500 (whichever is lowest) <\/span><\/p>\n<\/div>\n<\/td>\n<td id=\"E230\" colspan=\"1\" rowspan=\"1\">\n<div id=\"contents\">\n<p id=\"E234\"><span id=\"E235\" class=\"qowt-font2-TimesNewRoman\">x<\/span><\/p>\n<\/div>\n<\/td>\n<td id=\"E237\" colspan=\"1\" rowspan=\"1\">\n<div id=\"contents\">\n<p id=\"E240\"><span id=\"E241\" class=\"qowt-font2-TimesNewRoman\">Years of service (pro rata for any incomplete year)<\/span><\/p>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p id=\"E244\"><span id=\"E245\" class=\"qowt-font2-TimesNewRoman\">This is the standard amount you will get for a severance payment, but bargaining for more isn\u2019t going to hurt if you stand on reasonably good grounds. <\/span><\/p>\n<p><span id=\"E245\" class=\"qowt-font2-TimesNewRoman\">Start with taking a look at how much other employees in the same position were paid in the past.<\/span><\/p>\n<p><span id=\"E245\" class=\"qowt-font2-TimesNewRoman\"> In addition, you should negotiate clear terms with your employer regarding the payment of the severance. For example, if the severance is to be paid continuously for a period of time, <\/span><span id=\"E246\" class=\"qowt-font2-TimesNewRoman\">the terms should indicate <\/span><span id=\"E247\" class=\"qowt-font2-TimesNewRoman\">whether reemployment, disability or death would cease such payments. <\/span><\/p>\n<h5><span class=\"qowt-font2-TimesNewRoman\">Beyond the Paycheck<\/span><\/h5>\n<p id=\"E252\"><span id=\"E253\" class=\"qowt-font2-TimesNewRoman\">Other than severance payments, other possible items under a severance package are generally not regulated by the law, at least not in Hong Kong. <\/span><\/p>\n<p><span id=\"E253\" class=\"qowt-font2-TimesNewRoman\">However, it is up to employees and employers to negot<\/span><span id=\"E254\" class=\"qowt-font2-TimesNewRoman\">iate what they wish to include. <\/span><span id=\"E255\" class=\"qowt-font2-TimesNewRoman\">A severance package can cover items beyond <\/span><span id=\"E256\" class=\"qowt-font2-TimesNewRoman\">your salary<\/span><span id=\"E257\" class=\"qowt-font2-TimesNewRoman\">, <\/span><span id=\"E258\" class=\"qowt-font2-TimesNewRoman\">like <\/span><strong><span id=\"E259\" class=\"qowt-font2-TimesNewRoman\">stock options, health insurance, <\/span><span id=\"E260\" class=\"qowt-font2-TimesNewRoman\">outplacement assistance, <\/span><\/strong><span id=\"E260\" class=\"qowt-font2-TimesNewRoman\">and <\/span><strong><span id=\"E261\" class=\"qowt-font2-TimesNewRoman\">continued funding for <\/span><span id=\"E262\" class=\"qowt-font2-TimesNewRoman\">further<\/span><\/strong><span id=\"E263\" class=\"qowt-font2-TimesNewRoman\"><strong> education<\/strong>, to name just a few. Taking the arrangement of stock options as an example, an employee may request for a \u201c<strong>cashless exercise<\/strong>\u201d of <\/span><span id=\"E264\" class=\"qowt-font2-TimesNewRoman\">his\/her<\/span><span id=\"E265\" class=\"qowt-font2-TimesNewRoman\"> vested stock options, which means that he need not pay anything out of his own pockets to exercise the option. Alternatively, he\/she can bargain for an extension of the authorised period to exercise those stock options. <\/span><span id=\"E266\" class=\"qowt-font2-TimesNewRoman\">Attempts to bargain for these benefits can be futile, but it never hurts to try.<\/span><\/p>\n<h4 id=\"E268\"><span id=\"E269\" class=\"qowt-font2-TimesNewRoman\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-29281\" style=\"font-size: 16px;\" src=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-1024x721.jpg\" alt=\"\" width=\"1024\" height=\"721\" srcset=\"https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-1024x721.jpg 1024w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-300x211.jpg 300w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-768x541.jpg 768w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-640x450.jpg 640w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-1200x845.jpg 1200w, https:\/\/zegal.com\/wp-content\/uploads\/2019\/07\/adult-beverage-blur-618550-1920x1351.jpg 1920w\" sizes=\"auto, (max-width: 639px) 98vw, (max-width: 1199px) 64vw, 770px\" \/>Tips on N<\/span><span id=\"E270\" class=\"qowt-font2-TimesNewRoman\">egotiation<\/span><\/h4>\n<p id=\"E271\"><span id=\"E272\" class=\"qowt-font2-TimesNewRoman\">Negotiating a favourable severance package requires skill and tactics, and going in emotional is probably not going to get you anywhere.&nbsp;<\/span><\/p>\n<p id=\"E274\" class=\"qowt-li-2_0 qowt-list\"><strong><span id=\"E275\" class=\"qowt-font2-TimesNewRoman\">1.Know your standing and make reasonable demands accordingly<\/span><\/strong><\/p>\n<p id=\"E277\"><span id=\"E278\" class=\"qowt-font2-TimesNewRoman\">Taking an inventory of your own strengths is a good start. What\u2019s your historical worth to the company? How long have you stayed with your employer? Highlight your contributions and the reasons why you deserve a more generous severance package. <\/span><\/p>\n<p id=\"E280\"><span id=\"E281\" class=\"qowt-font2-TimesNewRoman\">Once you know your worth, set a reasonable range in your mind before entering any negotiation. A big mistake is to throw a random number <\/span><span id=\"E282\" class=\"qowt-font2-TimesNewRoman\">at your employer <\/span><span id=\"E283\" class=\"qowt-font2-TimesNewRoman\">as you may low-ball yourself or deter your employer from any genuine discussion if you come out too aggressive and without any consideration for the dollar amount. Looking into the company\u2019s financial soundness also helps. It\u2019s frivolous to bargain for something extortionate if you know the company is cash-strapped. <\/span><\/p>\n<p id=\"E285\"><strong><span id=\"E286\" class=\"qowt-font2-TimesNewRoman\">2<\/span><span id=\"E287\" class=\"qowt-font2-TimesNewRoman\">. Make the first offer or re-anchor<\/span><\/strong><\/p>\n<p id=\"E289\"><span id=\"E290\" class=\"qowt-font2-TimesNewRoman\">It may sound <\/span><span id=\"E291\" class=\"qowt-font2-TimesNewRoman\">risky to make an offer without first knowing where your employer stands but the truth is that the first offer sets the stage. Parties will work around the first number that was put on the table, and as a result, the actual outcome tends to resemble the <\/span><span id=\"E292\" class=\"qowt-font2-TimesNewRoman\">content<\/span><span id=\"E293\" class=\"qowt-font2-TimesNewRoman\"> of the first offer. Psychophysics describes this as the \u201c<strong>anchoring bias<\/strong>\u201d, which explains how individuals <\/span><span id=\"E294\" class=\"qowt-font2-TimesNewRoman\">are prone<\/span><span id=\"E295\" class=\"qowt-font2-TimesNewRoman\"> to rely heavily on the first piece of information they see and then adjust their values to assimilate towards that piece of information. P<\/span><span id=\"E296\" class=\"qowt-font2-TimesNewRoman\">utting this in context, if you set<\/span><span id=\"E297\" class=\"qowt-font2-TimesNewRoman\"> a particular standard at the start of the negotiation, chances are your employer will subconsciously use it as the \u201canchor\u201d for subsequent discussions and you can be in control what that anchor will be.<\/span><\/p>\n<p><span id=\"E302\" class=\"qowt-font2-TimesNewRoman\">So, making the first offer create<\/span><span id=\"E303\" class=\"qowt-font2-TimesNewRoman\">s a bias favourable towards yourself<\/span><span id=\"E304\" class=\"qowt-font2-TimesNewRoman\">, but what if your employer blurted out a number before you even opened your mouth? In this case, what you need to do is \u201cre-anchor\u201d the <\/span><span class=\"qowt-font2-TimesNewRoman\">discussion.<\/span><span id=\"E305\" class=\"qowt-font2-TimesNewRoman\"> L<\/span><span id=\"E306\" class=\"qowt-font2-TimesNewRoman\">et your employer know his offer is way off, and reset the standard at a level closer to your ideal number. Rank your demands and reject offers if necessary<\/span><\/strong><\/p>\n<p id=\"E312\"><span id=\"E313\" class=\"qowt-font2-TimesNewRoman\">It is important that you anticipate the possible scenarios, organise your thoughts, and rank the priority of your demands beforehand. Without <\/span><span id=\"E314\" class=\"qowt-font2-TimesNewRoman\">formulating a<\/span><span id=\"E315\" class=\"qowt-font2-TimesNewRoman\"> clear <\/span><span id=\"E316\" class=\"qowt-font2-TimesNewRoman\">picture in your head<\/span><span id=\"E317\" class=\"qowt-font2-TimesNewRoman\">, you may be thrown off guard when <\/span><span id=\"E318\" class=\"qowt-font2-TimesNewRoman\">your employer<\/span><span id=\"E319\" class=\"qowt-font2-TimesNewRoman\"> comes up with something you hadn&#8217;t considered. <\/span><span id=\"E320\" class=\"qowt-font2-TimesNewRoman\">If you have a<\/span><span id=\"E321\" class=\"qowt-font2-TimesNewRoman\"> clear ranking order, you\u2019ll <\/span><span id=\"E322\" class=\"qowt-font2-TimesNewRoman\">also <\/span><span id=\"E323\" class=\"qowt-font2-TimesNewRoman\">be able to balance the costs and benefits of accepting the terms. <\/span><\/p>\n<h4 id=\"E325\"><span id=\"E326\" class=\"qowt-font2-TimesNewRoman\">What To Do If Y<\/span><span id=\"E327\" class=\"qowt-font2-TimesNewRoman\">our Employer Makes You A Bad Offer? <\/span><\/h4>\n<p><span id=\"E327\" class=\"qowt-font2-TimesNewRoman\">In any event<\/span><span id=\"E328\" class=\"qowt-font2-TimesNewRoman\">, don\u2019t turn any offer down immediately, because this is the best opportunity for you to make trade-offs or counter offers.<\/span><span id=\"E329\" class=\"qowt-font2-TimesNewRoman\"> I<\/span><span id=\"E331\" class=\"qowt-font2-TimesNewRoman\">f your employer insists on offering<\/span><span id=\"E332\" class=\"qowt-font2-TimesNewRoman\"> you an insultingly paltry sum, walk away and let some time pass. It\u2019s wise to keep the space open and find another opportunity to negotiate instea<\/span><span id=\"E333\" class=\"qowt-font2-TimesNewRoman\">d of becoming hostile, which may <\/span><span id=\"E334\" class=\"qowt-font2-TimesNewRoman\">ruin any chances for further negotiation<\/span><span id=\"E336\" class=\"qowt-font2-TimesNewRoman\">. <\/span><\/p>\n<p id=\"E339\"><span id=\"E340\" class=\"qowt-font2-TimesNewRoman\">Each negotiation is unique and will depend on the circumstances of your departure, the company\u2019s culture, and the macroeconomy, all have bearing on the terms of your severance package. <\/span><\/p>\n<p><span id=\"E340\" class=\"qowt-font2-TimesNewRoman\">The ti<\/span><span id=\"E341\" class=\"qowt-font2-TimesNewRoman\">ps above form a general guide<\/span><span id=\"E342\" class=\"qowt-font2-TimesNewRoman\"> to advance your position.
