What is a Data Erasure Request Form?
A Data Erasure Request Form is used to make a request for the deletion of data under the GDPR. A request for erasure can be made by the data subject themselves, or by a third party on behalf of the data subject. If you are making a request on behalf of a data subject, you need to have proof of both your own and the data subject’s identities, as well as written authorization from the data subject to make the request on their behalf.
When can data erasure requests be made?
Data subjects can exercise their right to erasure when:
- The data subject withdraws their consent on storing and collecting data.
- The data subject believes the data is inappropriately used or unlawfully collected.
- The personal data is no longer necessary for the purposes for which it was originally collected.
- The collected data becomes a security threat for the data subject.
What is General Data Protection Regulation (GDPR)?
Every country has its own set of data protection and privacy laws. For e.g.: In the UK they have General Data Protection Regulation “GDPR”, In Singapore, they have PDPA, which stands for “Personal Data Protection Act 2010” which regulates the processing of all personal data that has been collected while making any commercial transaction. The General Data Protection Regulation (“GDPR”) is a new privacy law in the European Union (“EU”) that came into force on 25 May 2018. The GDPR regulates the protection of personal data, which includes any information that can be used to identify a person, such as a name, identification number, location data, or online identifier, and a wide range of other types of information.
How long do you have to erase data under GDPR?
Once a candidate has filed a Data Erasure Request Form an organization has to respond within 30 days under Article 12.3 of the General Data Protection Regulation (GDPR). However, the data erasure process can take up to 60 days depending upon the complexity of the request.
What should be included in a Data Erasure Request Form?
These are the important things that should be included in a Data Erasure Request Form. I.e.;
Details of information requesting party: A clear detail about the party requesting the information. This includes the full name, address, contact number, and email address of that person.
Data Subject Validation: if someone is requesting information on the data subject’s behalf, proper validation should be done, and the identity of that person should be recorded along with the consent letter from the data subject.
Details of data subject: Full details of the data subject including name, address, email, and contact number.
Reason for data erasure: A clear reason for erasing the data should be provided to the data controller officer.
Information to erase: This is the particular piece of information that a data subject wishes to erase or remove.
Declaration: A proper declaration should be signed by the data subject along with the current date of that request.
Right to Erasure Request Form
As a user, you are entitled to request the erasure of any personal data that is being held. Most data erasure forms will request some information such as personal identifying details of the person requesting it including name, address, contact info such as phone numbers and emails before proceeding with the deletion.
You will also be requested with proof of the identifying information provided along with the reason for the erasure request. You shall also be required to mention what information you wish to request erasure off. At the end of most forms, you will have to declare that you understand the terms and conditions and sign the requested document.
